  1. Acceptance of Terms Welcome to JoinCielo.Health (the "Company," "we," "us," or "our"). By accessing or using our website, mobile application, or telehealth services (collectively, the "Services"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our Services.

  2. Nature of Telehealth Services JoinCielo.Health connects patients with licensed healthcare providers ("Providers") for telehealth consultations.
    • Not for Emergencies: THE SERVICES ARE NOT INTENDED FOR MEDICAL EMERGENCIES. IF YOU BELIEVE YOU HAVE A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY.
    • Provider Independence: Providers are independent practitioners. The Company provides the technology platform but does not practice medicine. The advice you receive is the sole responsibility of the Provider.
    • Provider Network: JoinCielo.Health is contracted with MD Integrations. Please use the following link to access their website: https://mdintegrations.com/about
    • Technology Failures: You acknowledge that telehealth services rely on technology that may fail. We are not liable for lost connections or data delays.

  3. Mobile Messaging Terms (A2P 10DLC Compliance) By consenting to JoinCielo.Health SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of JoinCielo.Health through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology.
    • Service-Related Messages: May include updates, alerts, and information (e.g., order updates, account alerts, appointment reminders).
    • Marketing Messages: May include promotions, specials, and other marketing offers (e.g., cart reminders).
    • Voluntary Participation: You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with JoinCielo.Health. Your participation in this program is completely voluntary.
    • Charges: We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details.
    • Frequency: Message frequency varies.
    • Opt-Out: You may opt-out of the Service at any time. Text the single keyword command STOP to our number or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you.
    • Help: For Service support or assistance, text HELP to our number or email contact@ joincielo.health.
    • Carrier Liability: Carriers are not liable for delayed or undelivered messages.

  4. User Eligibility & Account Security You must be at least 18 years of age to use our Services. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

  5. Privacy Practices Your use of the Services is also subject to our Privacy Policy and, if you are a patient, our HIPAA Notice of Privacy Practices. Please review these documents to understand how we collect, use, and store your information.

  6. Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY LAW, JOINCIELO.HEALTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

  7. Governing Law These Terms shall be governed by the laws of the State of Florida, without respect to its conflict of laws principles.
